Dear members of our Society,

At February General Meeting Mr. Josef Voves pressed charges against Paul Kutil. The complaint was that Mr. Kutil removed $790 after New Year Party. Mr. Kutil insists, that he offset this sum against his reimbursement money. Is this really what triggered such proceeding? Mr. Kutil was in charge of the party and did a service for the Society.

Mr. Voves named two Jurors - Petr Bisek and Jerry Matejka and members voted Lawrence F. Jindra, M.D. as a Chairman of the Jury.

These gentlemen, as Jurors, were supposed to act in accordance with Article XV of our By-Laws. Unfortunately in their Judgment is almost nothing in accordance with our By-Laws.

Mistakenly they present Mr. Voves’ complaint as “Bohemian Citizens’ Benevolent Society of Astoria vs. Pavel Kutil”.

This Jury find in their Judgement Paul Kutil guilty on eleven counts noted in their findings. Ten of these counts have nothing to do with Mr. Voves’ complaint, three of them are even about different persons.

According to our By-Laws “The Jury may only consider evidence in line with the charges...” and there was only one charge. It is recorded in the minutes of February meeting that I asked Mr. Voves for clarification of charges, and he clarified clearly that there is only one charge.

Members of this Jury showed very poor judgment when they ruled on charges which they added on their own. What they produced is perfect mistrial and I would, if I may, suggest to do something urgently to prevent embarrassment. Those “findings” are asking for it.

Further, it is in our By-Laws that the Jury’s verdict will be either guilty or not guilty, and if guilty, the Judgment will be that offending members be either expelled or suspended... Nothing less and also nothing more. The Jury has no authority to make any additional decision. Therefore what they decided is simply out of order.

At the end I would like to caution the Board that Peter Kutil is our member and as a member he can say at our meetings whatever he wishes to say. “Decision” of the Jury that there is to be “an order of protection” if he states his mind at a General Meeting is quite absurd. Mr. Kutil’s statements were courteous, however difficult they may have been for the Board to respond to. And, “decision” to fine our manager Jan Bartunek because he did not inform police is not only absurd, but also illegal.

I hope that good and common sense will prevail.
